Andy's Assault is the assault on Andy Herrera by Jeremy Benanti.

Timeline[]

While drinking at Emerald City Bar with the rest of the team from the recently-closed station 23, Andy met Jeremy Benanti, who had gone to the fire academy with John Maddox but had moved to Oregon to work at a fire station there. When the rest of the team learned that a conversation Andy had led to 23 being shut down, they got angry and decided to leave to drink somewhere else, leaving Andy alone with Jeremy. Andy and Jeremy did shots together and talked about their careers.

At the end of the night, Andy and Jeremy stumbled out of the bar together. Andy knew she couldn't drive, so Jeremy offered to order her an Uber. She told him she could get one on her own, so he offered to share. She told him that she'd made a celibacy pact with her friend. Despite this, he kissed her. She said she was staying strong, but he could give her his number and she'd reach out when the pact was over. When she tried to leave, he pulled her back in aggressively, asking why she was being such a bitch. He pulled her back by her hair and pushed her into a wall. They struggled and she bit his hand, then punched him in the throat. He dropped to the ground and Andy ran away as he struggled to breathe on the ground. ("Alone in the Dark")

Andy ran from the bar to station 19, where she found Maya, Jack, and Carina out in the parking lot. They got Andy inside, where she said she didn't think she was injured. Sullivan went to examine her, but Carina stopped him, saying that Andy's body was evidence. Andy then remembered that she'd injured Jeremy and sent Maya, Vic, and Sullivan to take the aid car to find him. Carina then asked if Andy was okay with her calling the police to report the assault. Andy said that was okay.

Outside the bar, Vic, Maya, and Sullivan found Jeremy, who was unable to be roused. He was in a small space, so they had to move him to treat him properly. Vic tried to intubate, but there was blood in his throat, so Maya did a cricothyrotomy. As they prepared to get him into a backboard, Beckett arrived and told them they needed to call another team to take over for them because they were too close to the situation. They refused and said that Jeremy needed to get to the hospital as soon as possible. Beckett called for backup anyway as Jeremy flatlined, forcing Sullivan to start compressions. They were able to resuscitate Jeremy and took him to the hospital, where they handed him off to Teddy.

Back at the station, Andy talked to Officer Williams and Officer Roscoe about how the night had gone. She told them she thought she'd hit him in the throat and bit his hand. Williams asked if she did that because she thought he was going to assault her and she corrected that he had assaulted her and she thought he was going to rape her. She said she came to the station and sent her friends to tend to Jeremy, but couldn't remember how she got to the station. When they started to question her hazy memories, Andy asked to have Ben present with her while they talked.

Once Andy finished telling them everything she remembered, they prepared to leave. Ben asked about having evidence collected from Andy's body. Even though she wasn't raped, there was evidence on her body. He told Andy it was her choice, but it would put her in a good position to be believed. He offered to have the hospital send over a kit and have Carina do it and the collection would also confirm that she was healthy and unharmed, which was the most important thing. Andy agreed to do the kit, but only at the station.

Jack and Carina prepared the bathroom for Andy's exam. Taryn brought the kit and Jack left to give them some privacy. Carina introduced Andy to Taryn and Taryn asked for Andy's consent to do the exam. Andy said that wasn't necessary, but Carina said that control was taken from her and they wanted to give it back. She said that Andy could refuse any part of the exam and ask them to stop at any time. Carina began the exam, asking Andy for permission before each step. Once she finished, Carina sealed all the evidence into bags to hand over to the police. After the exam, Andy admitted to Carina that she'd been replaying the night. She had flirted with Jeremy and even kissed him. Carina told her that she could change her mind at any point, that consent was an ongoing negotiation. Carina then left Andy to take a shower.

Later, Detective Berarducci and Detective Chen came to the station to talk to Andy. Beckett said she'd already spoken to the police, but they clarified that they were homicide detectives, as Jeremy had died at the hospital. Sullivan went upstairs and told Andy that Jeremy had died and gave her the number of a lawyer. He also advised her not to talk to the cops. Andy ignored that and told the detectives the same story she'd told the first time, except that she remembered that she had run to the station. The detectives noted that the paramedics who treated Jeremy were her friends and knew that Jeremy had assaulted her. Andy said that was true, but they would never change the care they provided based on that. She said she was trying to help by talking to them, but she didn't have to. When they implied that Andy should have treated Jeremy, she said she wasn't a paramedic in that moment. She was a woman who had just been attacked. She asked to have an advocate like she had before, but they said no and she realized it was because she was a suspect instead of a victim. She told them that had happened and said she wasn't a criminal. She was attacked and defended herself. Andy then gave them the number of her lawyer and said to contact the lawyer if they had any more questions. They tried to stop her from leaving, but Beckett ordered them out of the station and said if they needed to speak to any of his paramedics, they'd have to put in a formal request through the department.

After they left, Andy got permission to stay at the station for the night. She climbed into a bunk and Jack lay behind her, holding her while Maya and Carina slept on a mattress on the floor next to that. Vic made a bed at the foot of the bunk while Travis, Ben, and Theo sat in the doorway.

The next morning, they decided to go out for breakfast together, but as they went to leave the station, Detectives Berarducci and Chen returned to arrest Andy. Andy went with them willingly. ("When the Party's Over")

At her arraignment, Andy learned she was being charged with first degree manslaughter. With her lawyer, Luisa Berrol, present, Andy pleaded not guilty. Pendleton set the trial for May 17 and bail at $100,000. Andy then got alerted that there was an article online about her, with some comments supporting her while others were critical of her. Vic spent the night at Andy's place, which she said she would continue to do until Andy stopped punching her in her sleep.

Andy met with Ross about her reassignment as she knew that Theo had already been reassigned while she hadn't heard. When Andy went to her meeting, she was upset to learn that because she was being charged with a felony, she was suspended from the department pending the result of her trial.

Andy went home after that conversation to find Elena waiting for her. She'd gotten the address from Sandra Alvarez. Elena apologized and held Andy as she cried. Elena told Andy about her own assault when she was at the academy. She was glad that Andy was able to fight Jeremy off. Andy thanked Elena for making sure she knew how to defend herself. Elena never reported her assault because the few people she told said it would only make her look bad. After talking things out, Andy and Elena danced together. ("Death and the Maiden")

While Andy was on a road trip with Jack, Luisa called Andy and told her the fire union had agreed to let her friends testify as character witnesses. She said that was a good sign as it meant the union was on her side. Andy talked to Jack about his own experience with being assaulted and realized there must be other women like her in Jeremy's past. ("The Road You Didn't Take)

Andy spent the next week searching for another woman Jeremy might have assaulted. She finally got a lead with a user called ClassOf08Dropout commented that Jeremy was a predator back in college. She just needed to go through a list of Jeremy's college classmates to figure out who didn't graduate.

Andy and Luisa met with James Pope, the prosecutor in Andy's case, who said that the footage showed Andy kissing Jeremy and then they went off camera and when they came back, Jeremy was on the ground and she was running away. Additionally, the bartender said they were flirting all night and the evidence collection gave them nothing. Andy said there were other victims. They had no record of it, but that's just because he was never held accountable. Pope said that Andy needed to bring him something more concrete than the anonymous tips they'd gotten.

Andy and Luisa went to a coffee shop where Andy told Luisa that she narrowed the list of possible women down to five. One of them didn't graduate and Andy had her picture. Luisa saw that the barista at the coffee shop was said woman. Andy and Luisa ordered drinks from Holly and then Andy explained who she was and why she was there. Holly agreed to talk to her off the record on her break.

Outside, Holly told Andy about being assaulted by Jeremy in college. She had dropped out of school because she couldn't remember what had happened that night. Later, when she remembered what had happened, she reported it, but wasn't believed. Andy then asked Holly for her help, saying she was looking at ten years in prison if convicted. Holly went back to the courthouse and agreed to talk to Pope. He dropped the charges against Andy. ("Crawl Out Through the Fallout")
